The following General Conditions of Sale (Conditions of Sale) govern the offer and sale of services on the site www.homelabmilano.com (Site). The services offered and purchased on the Site (Services) are sold and billed by:

Please read the Conditions of Sale carefully before placing an order. At the time of placing an order through the Site, confirming that you have read and accepted the Conditions of Sale, you declare that you unconditionally accept the conditions and terms specified below.

These Conditions of Sale, together with the purchase order sent by the user and the order confirmation sent by Carima srl , represent the contract for the supply of Services between Carima srl and the user. No other conditions or terms may apply. The contract may not undergo any changes, with the exception of those that Carima srl and the user can agree on in writing or by e-mail. A copy of these Terms of Sale may be stored electronically or printed.

 

1. Scope of Application.

1.1. The e-commerce activity of Carima srl is aimed exclusively at end users:

• that they are "consumers". By consumer we mean any natural person who makes purchases for purposes unrelated to any professional, craft, commercial or entrepreneurial activity carried out;

• who are over 18 years old, if Italian citizens, or who are of age with respect to their national law, if foreigners. If there is no national legislation in this regard, you must be at least 21 years old to make purchases on the Site.

 

2. Services - Methods of Purchase and Conclusion of the Contract.

2.1 The Services offered for sale by Carima srl are only those present on the Site at the time the order is placed by the user, as described in the relative information sheet, which illustrates the main characteristics (Product Sheet).

2.2 The user, to place an order, must select the desired Service from the shop on the Site ("Purchase" page), upload the Plan, images and other attachments using the appropriate "upload" function and fill in the fields on the right of the page using the "Compilation Guide" shown on the page itself. Choose the desired quantity (based on the number of rooms you want to design) and add service to the virtual cart, following the instructions that will appear on the Site itself, after carefully reading these Conditions of Sale, as well as the characteristics of the Service you intend to purchase. , the relative price and the shipping methods by e-mail. If the user wants to proceed with the purchase, simply move to the virtual cart, where all the data of the purchase order will be shown (including information relating to the Service purchased and shipped, the detailed indication of the price, the means of payment used and any additional costs), and click on the button "Checkout and confirm payment" or, for checkout and confirmation of payment with PayPal "Execute checkout with PayPal". By clicking "Checkout and payment confirmation" or "Checkout with PayPal" on the virtual cart page, the purchase order will be forwarded and the user will be obliged to pay the amount indicated in the order. "

2.3 Each order sent constitutes an offer to purchase the Services indicated therein. Orders are subject to the availability of the ordered Services and acceptance by Carima srl , which may, at any time and at its discretion, refuse to accept the order, including, for example, in cases where (i) orders come from a user with whom it has an ongoing legal dispute, or who has previously violated these Conditions of Sale and / or the terms of a purchase contract with Carima srl (ii) the orders come from users who have released data false, incomplete or otherwise inaccurate identifiers or contacts (iii) the orders relate to Services that are no longer available, (iv) an error has occurred on the Site relating to the Services ordered, for example in relation to the price or description of the Services.

2.4 If Carima srl is unable to accept the user's order, it will send an e-mail or contact the user by telephone at the addresses indicated by the same as soon as possible and in any case no later than 15 days from sending. of the order.

2.5 The acceptance of the order and the debit of the relative price on the user's credit card or other means of payment chosen, will take place only with the sending by Carima srl of an e-mail confirming the order ( Order Confirmation), which will confirm to the user that the order has been received and accepted. With the acceptance of the order, the conclusion of the contract will be perfected.

2.6 The user will subsequently receive another e-mail when the Service is sent (Shipping Confirmation). The Shipping Confirmation will contain all the information relating to the Service purchased and shipped, the detailed indication of the price, the delivery methods and any additional costs as well as the customer service contacts, which the user can contact for assistance and / or submit complaints. It is recommended to keep the Order Confirmation and the Shipping Confirmation as proof of purchase. If the Order Confirmation is not received by the user within 48 hours after placing the order, the user must contact Carima srl via e-mail at hello@homelabmilano.com or at 02-72003100 before making another order for the same Service.

2.7 After shipment, Carima srl will send the invoice to the user, to the e-mail address communicated in the order, using the data entered during the purchase in the "billing data" section.

3. Prices and Payment Methods.

3.1 The prices of the Services offered on the Site are expressed in Euros and are all inclusive of VAT. Any additional cost will be expressly and separately indicated in the order form, before the user proceeds with the transmission of the same.

3.2 The price of the Services can be modified by Carima srl at any time, without notice, it being understood that the price charged to the user will be the one published on the Product Sheet at the time the order is sent.

3.3 Orders will be accepted by sending the Order Confirmation. Carima srl will ship only after receiving confirmation of the authorization to pay the total amount due, consisting of the purchase price, the delivery costs, if applicable, and any other additional cost, as indicated in the order form. order.

3.4 Purchases can only be made by credit card or debit card or with PayPaI. Payments are managed through the Stripe and PayPal platforms.

3.5 The pages intended to manage the transaction are protected to allow maximum data protection. In no case and at no stage of the payment will Carima srl be able to know the information relating to the user's credit cards, which will be directly transmitted via a secure connection to the website of the bank that manages the transaction. Carima srl will not keep such data in any computer archive and therefore in no case can it be held responsible for any fraudulent and improper use of credit cards by third parties upon payment. Similarly, if the user chooses PayPal as a means of payment, he will be redirected to the site where he will pay for the Services according to the procedure provided and governed by PayPal and the terms and conditions of the contract agreed between the user and PayPal. The data entered on the PayPal site will be processed directly by the same and will not be transmitted or shared with Carima srl . The latter will therefore not be able to know and will not store in any way the data of the credit card connected to the user's PayPal account or the data of any other payment instrument connected with this account.

3.6 Any refunds due to the user pursuant to these Conditions of Sale will be made using the same payment method used by the user for the purchase or the other means agreed between the user and Carima srl . Once the credit order has been placed, Carima srl . cannot be held responsible for any delays or omissions in crediting the user with the amount to be reimbursed, to dispute which the user must directly contact the payment institution and / or PayPal, depending on the payment method used.

 

4. Delivery of Services.

4.1 The Services of Carima srl are sold in Italy and abroad.

4.2 The Services purchased are entirely digital and will be sent to the user's e-mail address in the form of a "Digital Book" in downloadable, printable and interactive .pdf format, containing the moodboard, the layout of the room or apartment and the elaborated renders according to the collection selected during the purchase phase, as well as a shareable link that will show the virtual tour of the project. Depending on the Service chosen by the customer, the book may also contain an additional section that includes a shopping list with all the commercial furnishings present within the project (with interactive links that refer directly to the seller's site), information relating to the brands of the suppliers and a technical specification that describes the aesthetic and qualitative characteristics of the chosen finishes.

4.3 The delivery times of the Services may vary with respect to what is entered on the Order Confirmation, for reasons not attributable to Carima srl . In the event of failure to indicate a specific delivery term in the Order Confirmation, delivery will in any case take place within thirty days from the date of conclusion of the contract. In any case, the provisions of art. 61 of the Legislative Decree of 6 September 2005, n. 206 (Consumer Code).

4.4 The Services will become the property of the user from the moment in which the latter receives them. As soon as the Digital Book has been sent, the user will become responsible for the Services and for any loss or damage subsequently suffered by them.

4.5 At the time of delivery of the Services, the user is required to check that the Digital Book is complete with all its parts, that it is legible, accessible and downloadable.

4.6 Having found any shortcomings, the user must report the irregularities to Carima srl ​​by sending an email to: hello@homelabmilano.com, to evaluate a possible refund or replacement of the service. In any case, the application of the rules on the right of withdrawal and the legal guarantee of conformity remains valid.

 

5. Right of Withdrawal and Return of Services.

5.1 The user has the right to withdraw from the purchase contract for any reason, without giving reasons and without any penalty, within 14 (fourteen) days from the date of delivery of the Services.

5.2 To exercise the right of withdrawal, the user must notify Carima srl of his decision to withdraw from the contract, by sending a written declaration containing the following information:

• Order number (communicated in the order confirmation email)

• Name and surname

• Email address

• List of services to be returned

• Bank details on which to obtain the transfer (IBAN), in the event that the user prefers the refund through a bank transfer rather than through the same payment method used by the user for the initial transaction.

5.3 Carima srl   will refund the user the full amount paid by the user within 14 (fourteen) days from the day on which it was informed of the user's decision to withdraw from the contract pursuant to this article 5. The refund will be made using the same means of payment used by the user for the initial transaction or other means agreed between the parties; in any case, the user will not have to bear any additional costs as a consequence of this refund.

 

6. Legal Compliance Guarantee.

6.1 All the Services sold on the Site are covered by the Legal Guarantee of Conformity provided for by art. 128-135 of the Consumer Code (Legal Guarantee). Carima srl has the obligation to deliver to the user services that comply with the sales contract.

6.2 Those detected by the user on the basis of purely subjective criteria and / or assessments or in any case not objectively measurable cannot be considered defects or faults in the Service.

6.3 The Legal Guarantee has a duration of 24 months starting from the delivery of the goods and the lack of conformity must be communicated to Carima srl within 2 months of discovery.

6.5 Carima srl will promptly reply to the report of the alleged lack of conformity and the specific procedure to be followed for the return of the Services will be indicated.

6.6 Carima srl will take delivery of the defective Service to verify whether or not what reported depends on a lack of conformity as identified above.

6.7 Having found the lack of conformity, the user has the right to restore, without charge, the conformity of the goods by replacement, or to an adequate reduction in the price or termination of the contract, pursuant to art. 130 of the Consumer Code without charge.
